Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Seaforge products, websites, and services (the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy.
If you use the Services on behalf of an organization, you represent that you have authority to bind that organization. You must comply with all applicable laws, including those related to privacy, anti-spam, and export controls.

Seaforge provides AI-powered tools to help you design, build, and communicate with your customers. Features may evolve over time; we may add, modify, or remove features with notice when practical.
We may use third-party providers (including Mailgun for email delivery and analytics services) to operate and improve the Services. Those providers act under agreements that protect your information.

You must be at least 18 years old and capable of forming a binding contract to use the Services.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

You may only send emails to recipients who have provided verifiable, opt-in consent or where you have another lawful basis (such as transactional messages related to an existing customer relationship). Purchased, rented, or scraped lists are prohibited.
You must honor unsubscribe requests, include clear sender identification, and comply with CAN-SPAM, CASL, GDPR, and other applicable anti-spam and privacy laws.
We use providers such as Mailgun to send and monitor email deliverability. Message content and delivery metadata may be processed by those providers solely to provide the Services and prevent abuse.

Paid plans renew automatically unless canceled before the renewal date. You authorize us to charge the payment method on file for recurring fees and applicable taxes.
Plan limits (for users, emails, storage, or compute) are described at signup. Exceeding limits may require upgrading plans or paying overage fees.
Fees are generally non-refundable except where required by law. We may suspend or downgrade accounts with unpaid fees after reasonable notice.

You retain ownership of content, prompts, data, and assets you input into the Services. You grant Seaforge a limited license to use that content only to provide, maintain, and improve the Services.
Generated outputs may be used by you subject to applicable law and third-party rights. You are responsible for reviewing outputs for accuracy and legality before relying on them.
All Seaforge trademarks, product names, and platform materials remain our property and may not be used without permission.

Do not use the Services to store or transmit unlawful, harmful, infringing, or deceptive content, including spam, malware, or content that violates intellectual property or privacy rights.
Do not attempt to probe, scan, or test the vulnerability of any system or to circumvent security or rate limits.
We may suspend or disable accounts that violate these Terms or applicable law, especially for abuse or harmful behavior.

AI-generated outputs can be inaccurate, incomplete, or outdated. You are responsible for independently verifying outputs before using them in production, legal, medical, or financial contexts.
Do not rely on the Services for life-support, safety-critical, or similarly high-risk scenarios.

Our data practices are described in the Privacy Policy. By using the Services, you consent to those practices.
We implement safeguards designed to protect your data; however, no system is perfectly secure. You are responsible for using strong credentials and access controls.

You may stop using the Services at any time. You may request account closure by contacting us.
We may suspend or terminate access if you breach these Terms, if required by law, or to prevent harm. Upon termination, your right to use the Services ends, but certain provisions (including limitations of liability) will survive.

The Services are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.
To the maximum extent allowed by law, Seaforge and its suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our aggregate liability under these Terms will not exceed the amounts you paid to Seaforge for the Services in the 6 months preceding the claim.

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Disputes will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction.
We may update these Terms to reflect changes to the Services or legal requirements. Material changes will be posted with an updated date. Continued use after changes means you accept the revised Terms.
